Overview

Zestyplan Inc. ("Zestyplan," "we," or "us") operates various plant-forward eating challenges and programs (collectively, "Zestyplan Challenges" or "Challenges") that empower participants to build sustainable eating habits through recipe-based activities. Zestyplan Challenges may be offered directly to the public or in partnership with organizations, events, universities, corporations, or other entities (each, a "Partner Organization").

These Challenges help people incorporate more plant-based meals into their regular routine while tracking their environmental, health, and financial impact. Challenge structures vary and may include long-form behavior change programs, one-time event-based challenges, partner-specific initiatives, or other formats.

The Zestyplan platform and associated mobile applications, websites, and digital tools (collectively, the "Platform") are made available to participants ("participants," "users," or "you") subject to these terms and conditions, including those set forth in our Privacy Policy (the "Terms"). By registering for, participating in, or accessing any materials from any Zestyplan Challenge, you agree to follow and be bound by these Terms, which may be updated by Zestyplan from time to time without notice to you.

Zestyplan and its third-party providers may make improvements and/or changes in the information, recipes, impact calculations, features, programs, and services described on the Platform ("Content") at any time without notice. Certain provisions of these Terms may be supplemented by expressly designated legal notices or terms located on particular pages of the Platform.

BY CONTINUING TO USE THE PLATFORM OR PARTICIPATE IN ANY ZESTYPLAN CHALLENGE, YOU ARE INDICATING YOUR AGREEMENT TO THESE TERMS AND ALL REVISIONS THEREOF.

Zestyplan reserves the right at any time to modify, suspend, or discontinue any Challenge or the Platform, temporarily or permanently, with or without notice.

Challenge Participation

Eligibility and Registration

Zestyplan Challenges may be open to the general public or may be restricted to specific groups such as employees, students, members, or residents of a particular geographic area, depending on the specific Challenge. By registering, you agree to provide accurate information during registration and to maintain the accuracy of your account information.

Some Challenges may require verification of affiliation with a Partner Organization or may use single sign-on (SSO) authentication, unique access codes, or other verification methods to restrict participation to eligible individuals.

Program Structures

Zestyplan Challenges vary in structure and duration. Challenge structures may include but are not limited to:

Long-Form Programs: Multi-week behavior change programs (typically 4-16 weeks) structured in phases, blocks, or "Shifts," each focusing on specific ingredients, cooking techniques, or themes. These may include live cooking classes, educational resources, progressive recipe unlocking, and community features.

One-Time Event Challenges: Time-limited challenges (typically one week to one month) asking participants to cook one or more plant-forward meals during a specific period, often tied to an event, awareness campaign, or seasonal initiative.

Partner-Specific Programs: Customized challenges designed in partnership with organizations to support wellness initiatives, sustainability goals, team engagement, or other organizational objectives. These may include team competitions, leaderboards, or organization-specific features.

Hybrid Models: Combinations of the above or other custom structures designed to meet specific participant or partner needs.

The specific structure, duration, activities, and requirements for your Challenge will be communicated through the Platform, registration materials, welcome communications, and ongoing program updates.

Participation Commitment

By participating in any Zestyplan Challenge, you commit to:

  • Cook one or more plant-forward meals using recipes provided through the Platform, as specified by your Challenge
  • Submit photos of your completed meals through the Platform to verify completion and track progress
  • Attend or watch recordings of live cooking sessions, if offered as part of your Challenge
  • Participate in good faith, including honest reporting and authentic engagement
  • If participating as part of a team or competitive element, respect other participants and competition rules
  • If sharing your experience publicly, do so in accordance with our community guidelines
  • Respect the purpose of the Challenge, whether environmental, health-related, community-building, or aligned with a Partner Organization's goals

Recipe Usage and Food Safety

All recipes provided are for informational purposes only. You are responsible for:

  • Following proper food safety practices
  • Accommodating your own dietary restrictions and allergies
  • Ensuring ingredient freshness and proper preparation
  • Consulting healthcare providers regarding any dietary concerns
  • Understanding that recipe outcomes may vary based on ingredients, techniques, and individual circumstances

Zestyplan makes no warranties regarding recipe outcomes and assumes no liability for food safety, allergic reactions, dietary impacts, or any adverse effects related to food preparation or consumption.

Content and Intellectual Property

Platform Content

The Platform and all Content, including recipes, impact calculations, educational materials, and design elements, contain proprietary information protected by intellectual property laws. Except as expressly permitted, you may not modify, copy, distribute, transmit, display, reproduce, publish, license, create derivative works from, transfer, or sell any portion of the Platform or Content for commercial purposes.

User-Generated Content

You retain ownership of content you create and submit to the Platform, including photos, videos, recipe modifications, and completion reports ("Your Content"). However, by submitting Your Content, you grant Zestyplan and any applicable Partner Organization a worldwide, perpetual, irrevocable, royalty-free, and non-exclusive license to use, distribute, reproduce, modify, adapt, publicly perform, and publicly display Your Content for:

  • Promoting Zestyplan Challenges and their environmental, health, and financial impacts
  • Educational and inspirational content creation
  • Marketing and promotional materials for current and future initiatives
  • Supporting Zestyplan's mission to democratize sustainable eating
  • Showcasing participant success and community engagement
  • Partner Organization internal communications, reporting, and promotional purposes (if applicable)
  • Research and analysis related to sustainable eating behaviors

Community Guidelines

By participating, you agree to:

  • Share authentic experiences and honest feedback
  • Respect other participants and maintain a supportive community environment
  • Not misrepresent your participation, meal completion, or environmental impact
  • Avoid sharing content that is offensive, harmful, misleading, or violates others' rights
  • Support fellow participants in their journey toward more plant-forward eating
  • Maintain conduct appropriate to the context of your Challenge, including professional conduct if participating through an employer or educational institution
  • Respect the privacy of other participants

Environmental Impact and Claims

Impact Calculations

Carbon impact, water usage, and cost savings calculations provided are estimates based on established environmental and economic data and may vary based on individual circumstances, ingredient sources, preparation methods, and geographic location. These calculations are provided for educational purposes to demonstrate the potential benefits of plant-forward eating.

Our environmental impact calculations compare each plant-forward recipe with a similar dish that includes animal protein, using the same serving size and cooking methods.

Our Data Sources:

  • Carbon emissions: Our World in Data, based on the largest global food systems study (38,700 farms across 119 countries)
  • Water usage: Water Footprint Network, the academic authority on water consumption methodology
  • Real-world equivalents: EPA data for vehicle emissions and household water usage
  • Cost data: USDA food price databases and Canadian grocery pricing averages

What We Measure:

  • Carbon footprint: CO2 equivalent emissions from farm to retail
  • Water footprint: Total freshwater consumption throughout production
  • Cost savings: Price differences between plant-based and animal protein options
  • Health benefits: Nutritional advantages based on dietary guidelines

Our Approach: We identify the primary ingredients in each recipe, calculate their environmental and economic impact per kilogram, and compare the plant-based version to its animal protein equivalent. We use conservative estimates and focus on the ingredients that drive the majority of impact.

Real-World Context: We translate the savings into relatable terms using EPA and USDA data—like miles of driving avoided, bathtubs of water saved, and dollars saved per meal—to help you understand the actual impact of your cooking choices.

Our Methodology: While we can't know exactly what you would have cooked otherwise, our standardized comparisons demonstrate the significant environmental and economic differences between plant-forward and animal protein-centered meals, helping you make more informed decisions in the kitchen.

No Guarantee of Specific Outcomes

While Zestyplan Challenges aim to create measurable environmental, health, and financial benefits through collective action and individual behavior change, Zestyplan makes no warranties about specific outcomes from individual participation. Results vary based on personal commitment, dietary starting point, implementation of program principles, and many other individual factors. Partner Organizations make no guarantees about specific wellness, sustainability, or engagement outcomes, though Challenges are designed to support organizational goals.

Platform Usage and Restrictions

Permitted Use

The Platform is for your non-commercial participation in Zestyplan Challenges. You may share your Challenge experience on social media and with your networks as encouraged by program guidelines. If participating through a Partner Organization, your access may be limited to the duration and scope of that organization's partnership with Zestyplan.

Prohibited Activities

You agree not to:

  • Access content or data not intended for you
  • Impersonate others or provide false information
  • Use automated tools to scrape or harvest Platform content
  • Interfere with the Platform's proper functioning or security
  • Use the Platform for any unlawful purpose
  • Reproduce or redistribute Platform content without permission
  • Create fake accounts or manipulate impact reporting
  • Share Platform access credentials with others
  • Use the Platform in any way that violates applicable Partner Organization policies, codes of conduct, or workplace/educational institution rules

Third-Party Services

The Platform may link to external websites or resources. We do not endorse or control these external sites and are not responsible for their content, privacy practices, or availability.

Third-Party Integrations

Zestyplan Challenges may integrate with third-party services such as video conferencing platforms, analytics tools, partner organization systems, or other technologies. Your use of these services is subject to their respective terms and privacy policies.

Partner Organizations

Some Challenges are offered in partnership with organizations that may provide additional benefits, rewards, team features, or other enhancements. These partnerships may involve data sharing as described in our Privacy Policy. Partner Organizations may have their own terms of use and privacy policies that apply to your participation.

Privacy and Data

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your personal information in connection with Zestyplan Challenges. If participating through a Partner Organization, please also review that organization's privacy policy, as certain information may be shared as described in our Privacy Policy. By participating, you consent to the data practices described in our Privacy Policy.

Disclaimers and Limitations

"As Is" Provision

Zestyplan Challenges and the Platform are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components.

Limitation of Liability

To the maximum extent permitted by law, Zestyplan, Partner Organizations, and their respective officers, directors, employees, and partners shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your participation in any Challenge or use of the Platform, including but not limited to damages for loss of profits, data, or other intangible losses.

Assumption of Risk

You acknowledge that cooking and food preparation carry inherent risks, and you participate in Zestyplan Challenges at your own risk. You are responsible for your own safety and for following proper food handling and preparation practices.

Indemnification

You agree to indemnify and hold Zestyplan, Partner Organizations, and their respective subsidiaries, affiliates, officers, agents, representatives, employees, and partners harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your participation in any Challenge, your use of the Platform, your violation of these Terms, or your violation of any rights of another person or entity.

Termination

Zestyplan reserves the right to terminate or suspend your participation in any Challenge or access to the Platform at any time, with or without cause and with or without notice, including if we reasonably believe you have violated these Terms. Partner Organizations may also terminate access if you are participating through their partnership. Upon termination, you will lose access to Platform content and your progress data, though you will retain ownership of any content you have created.

Changes to Terms

We may modify these Terms at any time by posting updated Terms on the Platform. Your continued participation in any Challenge after such changes constitutes your acceptance of the modified Terms. We encourage you to review these Terms periodically.

General Provisions

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.

Entire Agreement

These Terms, together with our Privacy Policy and any applicable Partner Organization agreements, constitute the entire agreement between you and Zestyplan regarding Zestyplan Challenges and supersede all prior or contemporaneous agreements and understandings.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. Zestyplan may assign these Terms without restriction.
